The Constitution sets out the branches in its first three articles: Article I for Congress, which makes the laws, Article II for the President, who carries them out, and Article III for the courts, which interpret them. The idea of separating these powers owed a great deal to the French writer Montesquieu, whose book The Spirit of the Laws, published in 1748, the Framers read closely.

Each branch can stop the others. The President can veto a bill, and Congress can override the veto with a two thirds vote in both houses. The House can impeach a federal official, and the Senate holds the trial. The Senate confirms judges, who then serve for life, and in Marbury v. Madison, in 1803, Chief Justice John Marshall established that the courts can strike down a law that breaks the Constitution.
